Dozens of sites announce €15M or 3% of worldwide turnover for a breach of the AI literacy obligation. Reading Article 99 in full: Article 4 is named nowhere in it. The provisions carried by the harmonised scale are Articles 5, 16, 22, 23, 24, 26, 31, 33, 34 and 50.
Penalties attached to Article 4 therefore fall under national law, which each Member State was required to lay down, with an operational framework from 2 August 2026.
What it means for an SME running AI
The obligation exists and it applies to you. It is not paid in a harmonised fine, it is paid in liability: to the customer who sends you a questionnaire, to an employee whose job quietly changed, to your insurer.
